PGM-Q Terms of Service

These terms cover your use of the PGM-Q application, published by PGM LLC ("we", "us"). By using the app you agree to them. If you do not, do not use the app.
Results
Results are computed from data you supply. PGM-Q performs the calculations described in the app using published statistical methods; it does not verify your measurements, specification limits, or sampling. You are responsible for validating any result before relying on it, including before submitting it to a customer or regulator. PGM LLC makes no warranty that a result is suitable for any particular submission.
Plans and payment
- Free covers everyday work: quick capability, simulation runs, small studies, and a limited number of saved records.
- Pro is $79 per year with a 7-day free trial on the annual plan, or $9.99 per month. It adds PDF reports, file import, non-normal capability, PNG export, run history, unlimited iterations and saved records, and sync across devices.
- Subscriptions renew automatically until cancelled. Cancel at any time — through the Stripe customer portal if you subscribed on the web, or through the app store account settings if you subscribed there.
- Cancelling stops the next renewal and leaves access running to the end of the period already paid for. We do not refund partial periods except where the law requires it, or where an app store's own policy applies to a purchase made there.
- Prices may change; a change never applies to a period you have already paid for.
Acceptable use
- Do not resell, sublicense, or redistribute the app or access to it.
- Do not reverse-engineer, decompile, or attempt to extract source code, except where that right cannot lawfully be excluded.
- Do not attack the service — no probing, overloading, circumventing plan limits, or attempting to reach another user's data.
- Do not use the app for anything unlawful.
Your data and our software
The measurements, plans and documents you put into PGM-Q are yours. We claim no ownership of them and no licence beyond what is needed to operate the service for you — storing and syncing your records at your request.
The app itself, its interface and its source remain the property of PGM LLC. Your subscription is a licence to use it, not a transfer of it.
Availability
The app works offline by design, so local use does not depend on us being reachable. Sync, sign-in and billing are online services that may be interrupted for maintenance or reasons beyond our control. We do not guarantee uninterrupted availability.
Disclaimer and limitation of liability
The app is provided "as is", without warranties of any kind to the fullest extent the law allows, including any implied warranty of merchantability or fitness for a particular purpose.
To the fullest extent permitted by law, PGM LLC's total liability arising out of or relating to the app is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, special or consequential damages, including lost profits, scrapped product, rework, or rejected submissions.
Nothing here limits liability that cannot lawfully be limited.
Termination
You may stop using the app at any time. We may suspend or end access for a material breach of these terms. You can ask us to delete your account and synced data as described in the Privacy Policy.
Changes to these terms
We may update these terms. The date above changes, and the updated version is published here before it takes effect. Continuing to use the app after that means you accept the change.
Governing law
These terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-laws rules. The courts of Indiana are the venue for any dispute, and each party consents to their jurisdiction.
